State sues ALF for multiple care problems

The West Virginia Office of Health Facility Licensure and Certification (OHFLAC) last week sued an assisted living facility and its administrator on allegations of poor care, reported the Charleston [WV] Gazette.
OHFLAC noted at least 16 violations found during routine inspections that were not fixed within the required time period. Additionally, the agency received complaints that an illiterate employee was working alone at the facility, in violation of a state law passed last year requiring at least one literate employee to be present in healthcare facilities at all times.
The lawsuit seeks to bar the admission of any more residents, shut down the facility within 30 days, and prohibit the facility's administrator from operating any healthcare facility in the state for five years, according to the Gazette.
