Confusion reigns over sex offenders in SNFs
LTC Liability Monitor, July 1, 2004
The Minnesota Attorney General (AG) clarified to the Corrections Department that it is legal to name nursing homes that house convicted sex offenders, according to the [Minneapolis] Star Tribune.
AG Mike Hatch informed corrections officials via letter that the department must disclose the names of SNFs that have sex offenders residing there, after cases of alleged sexual abuse came to light concerning sex offenders living in Concordia Care Center in Minneapolis. But the two state nursing home associations concur that there is much confusion whether this is a violation of privacy laws, the Star Tribune reported.
The Corrections Department is no longer placing sex offenders in nursing homes until it can devise a plan to ensure their separation from other residents.
