Nursing home faces False Claims charges

LTC Liability Monitor, July 1, 2004

A Warminster, PA nursing home faces charges filed by the federal government under the False Claims Act (FCA), reported The [Philadelphia area] Intelligencer.

Majestic Oaks-accused of failing to prevent pressure sores and resident falls as a result of inadequate supervision, as well as failing to properly care for related injuries-will pay $50,000 to the federal government and $25,000 to improve care as a result of a civil settlement. Because Majestic Oaks receives Medicare and Medicaid reimbursement, the federal government filed the case under the FCA.

An attorney for the facility's management company, Cherry Hill, NJ-based Seniors Management North Inc., told The Intelligencer that the settlement was reached without an admission of guilt.
