Confidential settlement in wrongful death case
LTC Liability Monitor, June 16, 2004
After a seven-day civil trial, parties in a wrongful death case reached a confidential settlement, the Associated Press (AP) reported.
Owners of Beverly Healthcare Southwest in McComb, MS, faced allegations of abuse and neglect following the August 2000 death of an 84-year-old resident. A former nursing supervisor testified that the resident received good care, and that discrepancies in facility records were a product of standard procedure and human error.
A nursing expert also declared the facility gave good care after spending 100 hours reviewing nearly 4,000 documents, according to the AP.
A Beverly spokesperson told the AP the case was settled on fair and equitable terms. The facility changed ownership last year and was renamed McComb Nursing and Rehab.
