Poor care may mean funding loss-but no lawsuit

After investigators determined deficient care at a Portland, ME nursing home led to a resident's death earlier this month, the Centers for Medicare & Medicaid Services threatened to suspend more than $1.5 million in federal funding, according to the Associated Press (AP).

The resident died after breaking both legs when a nursing assistant dropped her while trying to move her without assistance-although she required a mechanical lift and the assistance of two staff members.

The daughter of the 76-year-old resident does not plan to sue St. Joseph's Manor or the nursing assistant. "I visited her three or four times a week, and I'm sure she would have told me if anything was wrong . . . They treated her like family," she told AP.
