Choking death brings CMS’ heavy hand
LTC Liability Monitor, March 18, 2004
After a resident choked to death earlier this year at the Franciscan Villa in Milwaukee, WI, the facility faces several substandard care citations from the Centers for Medicare & Medicaid Services, reported the Milwaukee [WI] Journal Sentinel.
In addition to two citations related to the choking incident, the agency levied a $92,000 fine and six additional citations for failure to provide services such as adequate pain management, toileting, and repositioning for some residents.
A state report released last month detailed the staff's slow response in the choking incident-including failure to check the resident's air passage, lack of attempts to revive her, and failure to call paramedics until 15 minutes after the resident began choking.
