Wrongful death suit alleges inadequate supervision

After a mentally ill resident left his nursing home undetected and was struck by a train 300 feet away, Wheaton [IL] Care Center faces a wrongful death lawsuit alleging staff negligence and inadequate supervision.

Due to the resident's history of leaving the facility unattended-and often undetected-he was required to have an escort when moving between floors or leaving the building, reported the Chicago Daily Herald. The resident was not wearing an electronic monitoring device at the time of his death, although he had worn one for several months before.

State records show that the nursing home incurred daily fines for two months for deficiencies discovered during the investigation, as well as other fines for inadequate supervision, the Herald reported.
