U.S. Justice Department sues nursing home over questionable care

A 2002 investigation at the Nim Henson Geriatric Center in Breathitt County, KY, led the U.S. Justice Department last month to file a lawsuit under the Civil Rights of Institutionalized Persons Act (CRIPA).
Investigators found evidence of unnecessary feeding tubes and frequent usage of psychotropic medications not recommended for the elderly, reported the Lexington [KY] Herald Leader. 40% of the residents received more than 9 medications-some receiving up to 25-without clinical justification.
Rather than fines, the Justice Department will impose guidelines to solve the problems, the Leader reported.
