Elderly couple sues for the right to mail-order Canadian drugs

An elderly Illinois couple filed a lawsuit against the Food and Drug Administration (FDA) last week arguing that the law preventing mail-order drugs from Canadian pharmacies was unconstitutional, according to a report from www.consumeraffairs.com. 

Ray and Gaylee Andrews, both 74 years old, face roughly $800 a month in prescription drug costs. Buying them in Canada saves them nearly 43%. Illinois Governor Rod Blagojevich encouraged the couple to file the suit.

In the filing, the Andrews argue that the FDA is not being true to the constitution's equal protection clause by allowing Americans on the border to purchase Canadian drugs by driving into Canada, but threatening legal action against Americans who purchase cheaper Canadian drugs through the mail.
