Nursing homes, owner face $45 million in lawsuits

LTC Liability Monitor, February 26, 2004

The state of Arkansas sued five nursing homes and their Franklin, TN–based parent company Advocat, Inc. for allegations of abuse, neglect, and Medicaid fraud, reported the Associated Press (AP).

Six lawsuits involving 15 residents added up to demands for damages of $250,000 and civil penalties in excess of $45 million. The lawsuit that sought the highest penalty-more than $20 million-involved 2,040 alleged violations in a pattern of neglect at the Eureka Springs Nursing and Rehabilitation Center in Malvern, AR.

The details of a fatal choking incident at Conway Healthcare and Rehabilitation Center were obscured from the resident's family, another suit claimed, according to the AP.
