Lawsuit, financial struggles bankrupt LTC chain
LTC Liability Monitor, January 22, 2004
A $6 million wrongful-death lawsuit may be the straw that broke the camel's back for Goodwill Care Inc. of Everett, WA. The chain that once operated 10 long-term care facilities in the state has been losing money steadily over the last three years, and last month filed for liquidation under Chapter 7 bankruptcy, according to the Seattle Times.
The lawsuit involves the death of a 73-year-old resident who refused to eat or take her medication. State survey reports from December 2002 note that the facility failed to notify the resident's physician or family—a violation of state law—of the resident's refusals. The reports also recommended the revocation of the facility's license.
Owners Michael and Margaret Goodwill announced plans earlier last year to close three of their homes and sell the remaining seven, according to the Times.
