New Jersey ASCs face danger due to Codey ruling
Ambulatory Surgery Reimbursement Update, December 18, 2007
The Codey Act (N.J.S.A. 45:9-22.5), a November 20 ruling, may jeopardize the vitality of New Jersey ASCs across the state, according to a December 10 article in Forbes magazine online.
The ruling prohibits patient referrals to ASCs in which the referring physician owns an interest. The article states, "There are approximately 100 physician-owned ASCs in the State that deliver services in a far more efficient way than they could be delivered in the State's hospitals. If the ASCs suddenly closed, the hospitals could not handle the volume of patients."
