As providers replace traditional paper records with electronic document management systems (EDMS), some HIM directors are consulting legal counsel to make certain they'll be prepared when they receive a subpoena for a patient's medical record.
It's hazy what organizations must provide if they face a subpoena to produce an original medical record but have destroyed the patient's paper record after scanning it into their EDMS. Answering legal health record questions isn't simple, and rules can vary from one state to the next and among providers. HIM experts agree that you should look first to state and federal laws for guidance, then develop and consistently follow your own policies.
