New Hampshire to fight for prescription privacy law

New Hampshire Attorney General Kelly A. Ayotte will appeal a district court decision striking down the state's Prescription Information Law, which creates privacy protections for physicians. The law prevents pharmaceutical companies from obtaining physicians' prescription history and using the information to target their marketing efforts more effectively. In an April 30 decision, the court ruled that the law unconstitutionally restricts protected speech.

"The State has a substantial interest in protecting the privacy of New Hampshire physicians, defending the sanctity of the doctor-patient relationship and reducing healthcare costs," Ayotte said in a statement.
