CMS: If you don’t transmit, you’re not a covered entity

A provider that receives health information electronically but does not transmit any electronic health information is not a covered entity, according to a new frequently asked question (FAQ) on the CMS Web site.
For example, a provider that receives electronic remittance advice or payment electronically but does not conduct any other electronic transactions is not a covered entity.
CMS notes that Section 160.103 of HIPAA defines a covered entity as any healthcare provider "who transmits any health information in electronic form in connection with a transaction covered by this subchapter."
