OCR posts Medicare FAQ

Medicaid state agencies and Medicare Advantage plans may share protected health information (PHI) to identify dually-eligible enrollees, according to a new frequently asked question (FAQ) on the Office for Civil Rights (OCR) Web site.

Further, when the disclosure is made electronically, the "minimum necessary" rule does not apply to the disclosures of the data elements required by the standard transaction-as long as the standard transaction for eligibility is used. Disclosures made outside of the standard transaction must adhere to the "minimum necessary" rule.
