Microsoft backs new privacy rule

Microsoft put its support behind a federal privacy rule that supersedes current federal and state laws, including HIPAA.

In a recent speech and report, Brad Smith, Microsoft's lawyer, noted that there is a "bewildering jumble of overlapping state and federal laws" that makes it tough for businesses to comply, reports Computer Business Review (CBR). "For example, personal information collected by a bank is covered by one privacy standard, but that same information collected by a hospital is covered by a different standard," Smith said.

CBR reports that Microsoft has the following goals for a federal privacy law:

  • Precedence over all other state and federal privacy laws, and uniformity with foreign privacy rules
  • A transparency mandate that requires notifications when privacy policies are changed and a consumer right-to-know
  • A security aspect that protects against unauthorized use or loss of private data
