University Hospital faces class-action lawsuit over disclosures

A University of Missouri facility must defend itself against a class-action lawsuit brought on behalf of approximately 800 patients with liver diseases whose confidential medical records were disclosed, The Kansas City Star reports.
The lawsuit claims that records from Columbia, MO-based University Hospital were given to Pharmacy I.V. Associates of Cape Girardeau and Dexter. This company, which does business as home health care provider Option Care, then called patients to sell antiviral drugs and encourage patients to stay in the university network.
The university and Option Care asked for a dismissal of the lawsuit in Boone County Circuit Court, arguing there were no monetary damages and the doctor-patient privilege does not apply, reports The Star. The motion will be heard on October 24.
