OCR posts FAQ on disclosing PHI for retiree drug subsidy

Group health plans and health insurance issuers can disclose PHI to plan sponsors for the retiree drug subsidy without obtaining patient authorizations, according to a frequently asked question (FAQ) posted August 22 on the Office for Civil Rights Web site.
The privacy rule allows a group health plan or its health insurance issuer to disclose PHI to a plan sponsor to carry out plan administration functions, but the plan or issuer must limit the PHI to the minimum necessary, according to the FAQ.
