CCHP pushes for stronger enforcement

In order to better enforce the HIPAA regulations, HHS needs to launch a public education campaign, afford Americans the right to sue for privacy violations, and shift from a complaint-driven policy to active monitoring of organizations' compliance efforts, according to the Consumer Coalition for Health Privacy (CCHP). The group submitted these and other recommendations to HHS Secretary Leavitt during the open comment period for the proposed enforcement rule, which ended in June.

In calling for stronger enforcement of the privacy rule, the CCHP also recommended the final enforcement rule limit covered entities' ability to avoid penalty for violations under the law, as well as limit HHS' authority to provide waivers for civil monetary penalties or to settle cases.
