HHS publishes NPRM on HIPAA enforcement

The Department of Health and Human Services (HHS) published in Monday's Federal Register a notice of proposed rulemaking that amends the rules related to investigations of HIPAA breaches.
If passed, the new regulations would change
- the enforcement rules. Rather than applying to only the privacy rule-as they do now-they would apply to all HIPAA administrative simplification provisions.
- imposition of civil monetary penalties (CMP). The NPRM clarifies the investigation process, the process for determining CMP amounts, the grounds for waiver, and the hearing and appeals processes.
HHS will take comments on the proposed rule through June 17, 2005. Go to the Federal Register for more information.
