Philadelphia appeals court hears challenge to HIPAA privacy law

The Federal Appeals Court in Philadelphia heard a challenge Wednesday to the HIPAA privacy regulations from Delaware psychiatrist Janis Chester, who claims the rule is ineffective and doesn't protect patient information.

Although Chester understands the possible implications of a victory-amending a rule that's been in effect for two years and forcing healthcare providers to change their systems to meet a whole new set of requirements-she insists it must happen.

"Absolutely, it's broke. We have to fix it," she told KYW Newsradio 1060. A district judge previously heard and dismissed the case. The judge at the appeals court level has not yet made a ruling and didn't indicate a timeframe for one.
