HHS extends HIPAA enforcement rule

The Department of Health and Human Services (HHS) September 15 announced a one-year extension to the interim final rule establishing enforcement procedures for the HIPAA administrative simplification provisions. The rule, which originally expired on September 16, 2004, now expires September 16, 2005.

HHS extended this deadline to "avoid the disruption of ongoing enforcement actions while HHS proceeds with rulemaking to develop a more comprehensive rule," according to the September 15 Federal Register. The governing body plans to establish provisions for the enforcement of HIPAA through civil monetary penalties.

HHS does not expect to need the full year to issue guidance on this matter, but this amount of time should prevent the need for another extension. Go to the Federal Register for more information.
