Flagging resident sex offenders to other patients violates HIPAA, claims nursing home

Patients at a Minneapolis nursing home weren't aware of the sex offenders living in their midst because the nursing says state and federal privacy laws including HIPAA keep the offenders' criminal pasts private, the Associated Press (AP) reported June 9.

The home, Concordia Care Center, filed a claim with the district court claiming no responsibility under the law after the Minnesota Attorney General filed a law suit against the organization, according to the AP.

The suit alleges not only that Concordia failed to protect vulnerable residents against offenders, but that it also violated consumer laws by not revealing the patients' pasts to current and prospective residents, the AP said.
