HIPAA opponents appeal judge's decision

The Appeal for Patient Privacy Foundation challenged the dismissal of the Citizens for Health suit against the privacy rule, the Foundation reported May 27. 

Citizens for Health, a consumer advocate group comprised of 750,000 doctors and consumers, and 17 other individuals originally pursued the suit in January to give patients more leverage over disclosures of "routine" patient information to health plans, business associates, and medical billing companies, the HIPAA Weekly Advisor reported, April 12.

U.S. District Judge Mary A. McLaughlin dismissed the case and ruled that the Department of Health and Human Services (HHS) had not arbitrarily enacted the new provisions last April.
