Authorities, victims criticize HIPAA delay in drunk driving case

HIPAA restrictions kept Frank Parrish, North Caroline District Attorney, waiting an entire year for medical records related to two fatal drunk driving accidents, reports the Virginia Pilot, May 25.

Despite Parrish's claims of a year-long struggle, Sentara Norfolk General Hospital only became aware of the authorities' plans for the medical records when a subpoena arrived at the end of February, says the hospital privacy officer. Families of the victims were frustrated by the delay, as blood alcohol tests often play a pivotal role in convicting drunk drivers, according to the Pilot.
