New privacy laws could be in the works

A proposed amendment to the "Jumpstart Our Business Strength" (JOBS) legislation includes privacy provisions for health information in addition to those already mandated by HIPAA, reports the law firm of Vinson & Elkins LLP, May 12.

Senator Hillary Clinton's (D-NY) suggested addition to JOBS would not allow American businesses to send personally identifiable health information to entities overseas without meeting the certain requirements, Vinson & Elkins reports.

Under the proposal, to send information overseas businesses must

  • inform the individual if the country to which his or her information is being sent meets Federal Trade Commission certification standards for "adequate privacy provisions"
  • gain the individual's consent to send the information abroad
