New legislation that would provide legal safeguards to ensure data privacy protection could soon be in place in India, reports CIO Magazine.
India's Ministry of Information Technology and the National Association of Software and Service Companies are drafting the law and expect the legislation to be in place early next year. Although data protection provisions are usually written into service contracts for offshore outsourcing deals, no U.S. law currently prohibits information, including Social Security and driver's license numbers, employment histories, and medical records, from being shipped to or accessed from other countries.
The new law could prove beneficial for the outsourcing industry as well as American companies, which must comply with laws such as HIPAA, the Gramm-Leach-Bliley Act, and other state laws, reports the magazine.
