Delaware becomes one of first HIPAA-compliant states

Delaware is not only prepared to meet HIPAA's October 16 transactions compliance date, it is already in compliance with security rule requirements, according to Federal Computer Week (FCW).

The Centers for Medicare & Medicaid Services (CMS) recently certified Delaware's Medicaid system, which processes more than six million claims per year. Although state officials received formal notification of compliance in early July, the state implemented its Medicaid management information system in July 2002, reports FCW. The system is also compliant with security rule requirements, making the state prepared for the security rule's 2005 compliance date.

Because Delaware's system was certified by CMS, the federal government will pay 75% of all transaction expenses made through the compliant system and the state will pay 25%. Without certification, the state would have had to pay 50%.
