HHS issues HIPAA enforcement, research documents

Less than a week into mandated compliance under the HIPAA privacy regulations, the Department of Health and Human Services (HHS) issued two new documents aimed at reinforcing and clarifying it's rules. On April 17, HHS published "Civil Money Penalties: Procedures for Investigations, Imposition of Penalties, and Hearings" in the Federal register. This document announces that the Office for Civil Rights can now fine facilities up to $100 for each privacy rule violation and as much as $25,000 per year for similar violations of the same requirement. This rule will be in effect from May 19 to September 16, with HHS accepting public comment through June 16. HHS also issued guidance for researchers on April 16. The guidance responds to concerns mentioned in an April 9 letter from Eli Lily & Co. Chief Privacy Officer Stan Crosley. The guidance says that institutional review boards are not required under the privacy rule to review HIPAA authorizations used for research.
