AHA, NEMA provide sample business associate agreement for medical device manufacturers

The National Electrical Manufacturers Association (NEMA) recently released a sample business associate agreement for its medical device manufacturers to use with hospitals. The American Hospital Association (AHA) worked closely with NEMA to ensure that the agreement properly incorporates privacy rule requirements and addresses business concerns of both hospitals and their business partners who are NEMA members.
Each hospital should work with legal counsel to ensure that the NEMA sample agreement is appropriate for the organization's unique situation and precise business relationship needs, according to the AHA. NEMA expects to make no further changes to the language of the agreement at this time.
