Q: Patients often send photographs of their babies who were delivered or cared for at the hospital where I work. Is posting a photograph either with or without the patient's name and a birth announcement a HIPAA violation?

A: While parents have voluntarily shared their babies' photographs with their healthcare providers, these photographs should not be posted in a public place because HIPAA considers a full-face photograph PHI. Posting these photographs in a staff-only area where viewing is limited to those involved in the provision of care is acceptable.

Editor’s note: Mary D. Brandt, MBA, RHIA, CHE, CHPS, vice president of health information at Baylor Scott & White Health in Temple, Texas, answered this question for HCPro’s Briefings on HIPAA newsletter.
