HITECH promises, but does it deliver?

With newfound authority, some state attorneys general (AG) are beginning to take aim at covered entities (CE) that run afoul of HIPAA's Privacy and Security Rules.
It's just one new opportunity the HITECH Act created for aggressive enforcement of HIPAA. The new legislation included:
- Tougher penalties
- Enforcement authority for state AGs
- Breach notification rules
- Periodic audits by the Office for Civil Rights
Some say the HITECH Act has made a difference; others argue that not much has changed with respect to real enforcement. So what happened in 2010 regarding enforcement, and what looms ahead this year?
