Those waiting for the final security rule and transactions and code sets changes shouldn't have to wait much longer. The Office of Management and Budget's (OMB) Web site lists both as under review as of January 13.
Final clearance by the OMB normally takes between two weeks and 90 days. The final version of the regulations will then be displayed at the Government Printing Office in Washington, DC, and published in the Federal Register.
The American Health Information Management Association (AHIMA) urged HHS to quickly release the final security rule in a January 6 letter to HHS Secretary Tommy Thompson and Department of Defense (DOD) Secretary Donald Rumsfeld.
The association expressed concern over the loss of thousands of health records by a DOD contractor (see the January 13 issue of HIPAA Weekly Advisor), as well as HHS' failure to issue a final security rule.
"AHIMA's members are very concerned about these two incidents and the message they send to the public," read the letter.
