HHS needs further review on breach notification final rule

The Office for Civil Rights (OCR), the enforcer of the HIPAA privacy and security rules, announced July 28 that it withdrew the final rule on breach notification from the Office of Management and Budget (OMB) for further review.

OMB reviews all rules before they are published in the Federal Register.

“This is a complex issue,” OCR writes on its website, “and the Administration is committed to ensuring that individuals’ health information is secured to the extent possible to avoid unauthorized uses and disclosures, and that individuals are appropriately notified when incidents do occur. We intend to publish a final rule in the Federal Register in the coming months.”

The breach notification interim final rule is still in effect.
