Security rule still not finalized

The final security rule did not appear in the December 27 Federal Register, contrary to rumors that indicated it would.

The reason for the delay is probably the complexity of ensuring that the final security rule matches the privacy rule, says William M. Miaoulis, CISA, principal at Phoenix Health Systems, in Montgomery Village, MD. "HHS wants to make sure they get it right, because of the need for those to work together. It's a complicated task."

Security measures enable facilities to protect privacy, he says. "And people need to understand that security is just good practice today, whether we have standards or not."

HHS has not indicated when the final rule will be published. There was no mention of the rule or the final transactions and code sets changes in the December 27 Federal Register.
