Establish marketing policies and procedures now

If your facility hasn't developed policies and procedures for marketing under HIPAA's final privacy rule, don't wait another minute.
"It's a horse race right now," says Tom Hanks, director of client services for the health care practice at PricewaterhouseCoopers, LLP, in Chicago.
"You should have all of your policies completed. Without them, you can't develop your notice, train staff, or work on establishing procedures for implementing and sanctions for enforcing those policies, he says.
"Some people were working on their policies and procedures all along, knowing there would be changes. And with the exception of consent, the August 14, 2002, final changes didn't bring any major surprises."
The privacy rule defines marketing (Section 164.501) as "a communication about a product or service, a purpose of which is to encourage recipients of the communication to purchase or use the product or service, subject to certain limited exceptions."
