Q: Has HITECH enforcement been delayed?
A: Reports surfaced February 19 that HHS is, in fact, delaying enforcement of the HITECH compliance deadlines that recently passed, most notably, that business associates must comply with the HIPAA security rule and the use and disclosures provision of the privacy rule. (That enforcement deadline was February 17.)
But HHS has made no formal announcement as of this time and experts continue to say that providers should not count on a delayed enforcement deadline.
