HITECH -- where is the concern?

Check out this January 5, 2010, HIPAA Update post from a privacy and security officer:
Are most covered entities employing the ostrich methodology for HITECH compliance, or am I missing something?
Are they sending letters to their application vendors and asking about encryption, or are they planning on deploying encryption themselves even if it violates FDA requirements?
Are they updating their internal processes and checking their interfaces and exports to make sure that health plans won’t have post claim access to self pay claims?
I don’t see the discussion of these issues, other than breaches, and it leaves me unsettled.
