Check out this post on breach notification by Frank Ruelas, director of compliance and risk management at Maryvale Hospital and principal, HIPAA Boot Camp, in Casa Grande, AZ:
Given news articles about recent breaches which would trigger notifications under both state breach notification laws and under the HITECH Act breach notification requirements, it seems that covered entities are taking a long time in notifying those affected by the breach.
Case in point, the HealthNet breach occurred six months ago, and HealthNet states that it is looking to send out letters on or about November 30?
Even with an accommodation for a delay for law enforcement reasons (there is nothing in recent news articles to indicate this is applicable) it seems things are moving exceptionally slow.
