BA agreements: Consider additions to new contracts

The American Recovery and Reinvestment Act of 2009 hit business associates (BA) hard because they now must abide by the HIPAA security rule. However, the compliance date for changes associated with the Health Information Technology for Economic and Clinical Health (HITECH) Act is not until February 10, 2010. Covered entities shouldn’t panic either, experts say. During the next eight months, health industry experts expect HHS to issue guidance that will clarify provisions pertaining to BAs, including their new role as HIPAA security rule–covered entities. Further, covered entities can expect to better understand how HITECH will require them to draft BA agreements in the future.
