Hospitals seeking further discussion about CMS’ clarification of physician supervision requirements under “incident to” got what they wanted— but, the information provided during CMS’ February 25 Hospital and Hospital Quality Open Door Forum (HODF) is likely to spark more questions and it raises significant compliance issues.
“CMS’ clarification regarding the definition of department leaves the determination up to the hospital,” says Kimberly Anderwood Hoy, JD, CPC, director of Medicare and compliance at HCPro, Inc., in Marblehead, MA. “For many hospitals, that may mean going back to the drawing board and figuring out exactly how department lines are drawn.”
