Hospitals looking for more discussion about CMS’ recent clarification of the direct supervision requirements under “incident to” got what they wanted during the February 25 Hospital and Hospital Quality Open Door Forum (HODF). But the additional information is likely to spark more questions and raises significant compliance issues for hospitals.
“CMS’ clarification regarding the definition of department leaves the determination up to the hospital,” says Kimberly Anderwood Hoy, Esq., JD, CPC, director of Medicare and compliance at HCPro, Inc., in Marblehead, MA. “For many hospitals, that may mean going back to the drawing board and figuring out exactly how department lines are drawn.”
