News: CMS to challenge successfully appealed RAC denials, AHA News Now reports

A story published in the June 6, 2008, issue of AHA News Now states that CMS plans to challenge certain Recovery Audit Contractor (RAC) denials that were reversed on appeal in the five RAC demonstration states. Administrative law judges have overturned RAC denials by stating that the RACs lacked "good cause" to audit claims more than a year old, AHA News Now reports. CMS plans to challenge these successful appeals on the grounds that RACs demonstrated "good cause" and that the administrative law judges lack jurisdiction on this issue.
