The initial investment in legal counsel up front outweighs the risk of misunderstanding conflicting laws after the fact. In particular, with the migration from paper charts to an EHR, various healthcare professionals will have different opinions about which documents are part of the legal health record. Legal advisement will provide your hospital with an additional layer of protection as you attempt to compile the federal and state regulatory guidelines, professional practice standards, payer requirements, accreditation agency guidelines, and organizational policies and procedures to create and maintain your legal health record, regardless of its format.

Editor’s note: This week’s tip was adapted from HCPro’s book, "The Legal Health Record Companion: A Case Study Approach." For more information or to purchase a copy of this book, visit www.hcmarketplace.com/prod-4541.html.
