CMS published federal regulations in the Federal Register that were effective for history and physical exams, verbal orders, security of medications, and postanesthesia evaluations as of January 2007. Subsequent changes effective January 2008 were published for H&Ps and postanesthesia evaluations.
CMS published the final Interpretive Guidelines for these four issues on February 8 (Memo 08-12, available at www.cms.hhs.gov/SurveyCertificationGenInfo/PMSR/list.asp). The final Interpretive Guidelines included information about the regulation changes in 2007 and 2008.
So what was the issue with the postanesthesia evaluations and what change was made? In the earlier 2007 rules, CMS believed the same standard for postanesthesia evaluations should apply to inpatients and outpatients. The increased complexity and types of outpatient procedures being performed today require this.
