Tip: Know your hospital's responsibility for responding to amendments

HIPAA requires covered entities (CE) to respond to a request for a medical record amendment within 60 days of receipt. If a CE is unable to act on the request within 60 days, it may extend the time for up to 30 days. HIPAA allows only one extension, and the CE must provide the individual a written statement of the reasons for the delay and the date by which it will complete its actions with respect to the request.

Hospitals aren't required to accept every amendment that patients file. A CE can deny a request if it determines that the information is accurate and complete as it stands, or if the request involves information that:

  • Did not originate with the CE
  • Is not part of the designated record set
  • Is not available for inspection
