CMS Reverses Position on Use of HHABN Related to Physician Encounter

Since the final rule was issued, the Centers for Medicare and Medicaid Services (CMS) has maintained that providers are not allowed to utilize the Home Health Advanced Beneficiary Notice (HHABN) in relationship to the failure of the required face-to-face physician encounter taking place. However, in response to legal arguments, CMS has reversed their position.

The HHABN has been revised by CMS to include three option boxes for use in a variety of situations. Option Box 2 was originally intended for notifying beneficiaries of reductions and termination for reasons other than “non-coverage”. Now, CMS states that the use of Option Box 2 is appropriate and must be used when agencies are notifying beneficiaries of the discontinuation of services because of failure to meet the face-to-face encounter requirements.
