Tips for soliciting bids for exclusive contracts

When using a request for proposal (RFP) process to solicit physicians for hospital-based exclusive contracts, be careful not to seek free services that might violate the anti-kickback statute. Frequently, hospitals use RFPs to obtain the lowest price for the most work, which could create kickback problems in the case of exclusive contracts. If there's a bidding war among physicians for the exclusive arrangement, it creates a situation where they may be willing to offer more free services that the hospital might reasonably require.
