State hospital association takes stand against criminal charges for medical error

The Wisconsin Hospital Association (WHA) issued a recent statement against the criminalization of medical errors. The announcement took place after the state of Wisconsin filed criminal charges against a nurse who mistakenly administered an epidural intravenously, resulting in a patient's death.

 

In its official announcement, the WHA stated that action by the Wisconsin Department of Justice "will actually have a negative impact statewide on the accessibility to and quality of care provided in Wisconsin. By setting a precedent that the [Wisconsin] DOJ will pursue criminal charges against health care professionals who make unintentional human errors, the DOJ sends a chilling message to health care professionals now in the state, and to those who are considering practicing here."

 

The action was taken by the Wisconsin DOJ. The Institute for Safe Medication Practices followed this announcement by releasing a statement supporting WHA's position, saying that "the goal of patient safety is better served by determining the system-based weaknesses that led to this error, sharing lessons learned with others, and taking action to prevent similar errors, rather than engaging in egregious criminal prosecution of a single individual," according to an announcement by the American Hospital Association.
